Arizona requires every employer in the state to use the federal E-Verify program to confirm employment eligibility of all newly hired workers.
The Legal Arizona Workers Act, codified at ARS 23-211 through 23-216, mandates that after hiring an employee, every employer in Arizona must verify the employment eligibility of the employee through the federal E-Verify program. The Attorney General or county attorney investigates complaints of knowing or intentional hiring of unauthorized aliens. First violations result in probation and a court order to terminate unauthorized employees. A second knowing violation during probation results in permanent revocation of all business licenses. Employers must also keep verification records for the duration of employment.
