NCGS 162-62, strengthened by House Bill 10 in 2024, requires jails to determine the immigration status of prisoners charged with qualifying offenses, query ICE when status cannot be verified, and hold prisoners subject to ICE detainers and warrants for judicial review and transfer. Local governments cannot prohibit officers from communicating with ICE and cannot create sanctuary jurisdictions. The law applies statewide and overrides any conflicting local resolution or ordinance.
Local sanctuary policies are void and unenforceable; local officials may face civil action and loss of certain state funds, and noncompliant detainer policies expose jurisdictions to liability.
