New Hampshire bars municipalities from adopting sanctuary policies that limit cooperation with federal immigration enforcement. HB 511 and SB 62, signed by Governor Ayotte in 2025, prohibit sanctuary policies statewide, with most of HB 511 taking effect January 1, 2026.
New Hampshire enacted its anti-sanctuary laws in 2025. HB 511 prohibits any state or local entity or law enforcement agency from enacting, adopting, or maintaining a sanctuary policy that restricts cooperation with federal immigration authorities, and SB 62 requires local cooperation with immigration enforcement. Governor Ayotte signed both in May 2025; most of HB 511 took effect January 1, 2026, while some SB 62 provisions became effective July 21, 2025. An earlier bill, HB 1292 (2024), failed and never became law. Existing sanctuary-style policies are void, and the Attorney General may seek enforcement against noncompliant municipalities.
Municipalities or officials that maintain sanctuary policies face Attorney General enforcement, including suits for injunctive relief, and potential loss of state funding.
