Since 2015, New York State regulation 6 NYCRR Part 575 has prohibited the possession, transport, importation, sale, purchase, and introduction of select invasive species, including two species of running bamboo. Running bamboo spreads aggressively through underground rhizomes and can quickly invade neighboring properties, damage foundations, and displace native vegetation. While NYC does not have a separate municipal bamboo ordinance beyond the state regulation, property owners are responsible for preventing the spread of any bamboo to neighboring properties. Clumping bamboo varieties that do not spread aggressively are not prohibited. Violations of the state invasive species regulation can be reported to the NYS Department of Environmental Conservation or through NYC 311.
Violations of 6 NYCRR Part 575 are enforced by the NYS Department of Environmental Conservation. Penalties can include fines for the sale, transport, or intentional planting of prohibited species. Property owners may also face civil liability if running bamboo spreads to and damages neighboring properties under common-law nuisance and trespass theories.
