California Assembly Bill 2561 (effective January 2023) explicitly prohibits cities and counties from banning the use of drought-resistant and water-efficient landscaping including edible plants in residential yards. San Diego's Water Efficient Landscape Ordinance (SDMC Β§142.0403) actively encourages removal of water-intensive lawns in favor of drought-tolerant, native, or edible landscaping. The San Diego County Water Authority offers turf replacement rebates through its WaterSmart programs. The city does not restrict the types of edible plants grown in residential front yards as long as the garden is maintained. Front yard gardens must not obstruct public sidewalks, rights-of-way, or sight lines at intersections. Raised beds, container gardens, and in-ground plantings are all permitted. Properties in planned communities may have additional HOA restrictions, though California Civil Code Β§4750 limits HOA authority to restrict drought-tolerant landscaping.
No fines for having a front yard garden. Unmaintained gardens that create blight or pest conditions may trigger property maintenance code enforcement. Gardens must not obstruct public sidewalks or rights-of-way.
