Tree regulation in Dutchess County operates at the municipal level with no countywide rule. City of Beacon Code Chapter 204 protects trees on public property and within rights-of-way; removal of trees over 8 inches diameter at breast height (DBH) requires a permit from the Highway Superintendent or Tree Committee. Village of Rhinebeck and Town of Red Hook have tree-planting and street-tree protection in their subdivision regs. NYS DEC Article 24 (Freshwater Wetlands Act) and Article 15 (Stream Protection) require DEC permits to remove trees within regulated 100-foot wetland buffers or within protected stream corridors.
