Under Houston Code Chapter 33, Art. VI, certain trees are protected and require a permit before removal. Protected species include Live Oak, Pecan, Magnolia, and Bald Cypress. To obtain a permit, property owners must file a written notice of intent with the Urban Forestry Division at treepermit@houstontx.gov or call (713) 867-0378. Permits are valid for one year with a processing time of approximately 10 business days. Plan review and inspection are required. Property owners who unnecessarily destroy protected trees face fines of $90 per diameter inch. General violations can result in $500 per day fines. Lots under 5,000 sq ft require at least one tree (new or preserved). Waivers may be granted when compliance would damage utilities or create unsafe conditions.
