Wake County does not regulate routine tree trimming on private property. Branches encroaching from a neighbor's tree may be trimmed back to the property line under longstanding NC common-law 'self-help' rule (Melin v. Richman, NC 2004), but cutting beyond the line or harming the tree's health can create liability.
Unincorporated Wake County has no tree-trimming permit requirement and no preservation ordinance for residential trees outside specific overlay districts. The Wake County UDO Article 9 (Stormwater & Buffers) protects Neuse Riparian Buffers β the 50-foot strip from any perennial or intermittent stream β and 15A NCAC 02B .0233 prohibits cutting most vegetation in those buffers without permit. Outside riparian buffers, you may trim or remove trees on your own land freely. For a neighbor's tree overhanging your property, NC common law allows self-help trim back to the line; you cannot enter neighbor's land or take measures that would kill the tree. Duke Energy and city utilities have separate easements allowing them to trim around lines.
