Residential pool barriers in unincorporated Wake County are governed by the NC Residential Code Appendix V (formerly AG), which requires a barrier at least 48 inches above grade around any in-ground or above-ground pool holding more than 24 inches of water. Public and semi-public pools follow 15A NCAC 18A .2528 (NC Public Swimming Pool Rules).
Under NC Residential Code (NCRC) AG105, the barrier must be 48 in (1219 mm) minimum above grade measured on the side away from the pool, with no more than 2 in (51 mm) clearance under the barrier. Openings must not allow passage of a 4-inch sphere. Where horizontal members are less than 45 in apart, they must be on the pool side and vertical spacing must not exceed 1.75 in. Chain-link mesh cannot exceed 1.25 in unless slats reduce openings to 1.75 in or less. Pedestrian gates must open outward, be self-closing and self-latching, with the release at least 54 in above grade or on the pool side. Doors from the dwelling into the pool yard require an alarm or other approved barrier. For public pools, 15A NCAC 18A .2528 sets a parallel 48-in barrier standard enforced by Wake County Environmental Health.
Violations are stop-work or stop-fill orders from Wake County Inspections; a pool cannot be filled or operated until the barrier is brought into compliance. Public-pool barrier defects can trigger permit suspension by Environmental Health under 15A NCAC 18A. Pools permitted before April 1, 2010 with non-compliant fences are grandfathered unless 50% damage or replacement occurs.
