Wilmington requires property owners to maintain trees. The Land Development Code includes tree protection provisions (Article 8).
Property owners are responsible for maintaining trees on their property. Trees overhanging sidewalks must provide at least 8 feet of clearance, and trees over streets must provide 14 feet. The Land Development Code Article 8 addresses landscape and tree protection. Hazardous trees must be addressed promptly. Tree trimming near power lines should be coordinated with Duke Energy.
Failure to maintain hazardous trees results in code enforcement action and liability for damages.
