Under RSA 259:23 and related statutes, Class 1 e-bikes provide pedal assist up to 20 mph, Class 2 add throttle assist up to 20 mph, and Class 3 provide pedal assist up to 28 mph. Class 1 and 2 bikes are generally allowed wherever traditional bicycles are permitted, including the Heritage Trail along the Merrimack and on-street bike lanes. Class 3 bikes are allowed on roads but may be restricted on multi-use trails depending on land manager rules. Riders under 16 may not operate Class 3. Helmets are required for riders under 16. No e-bike registration or insurance is required.
Operating a Class 3 bike under age 16 or without a required helmet violates RSA 265 and can result in citations or warnings, typically $25-$100.
