Bars, lounges, taverns, and nightclubs in Loudoun County are subject to both Zoning Ordinance noise limits (Section 5-1507) and the general noise ordinance (Chapter 654.02). The definition of 'restaurant' in Chapter 654.02 explicitly includes bars, lounges, taverns, coffee shops, and cafes. Amplified music audible at 100 feet or more is specifically prohibited, with enhanced restrictions between 11 PM and 7 AM. Maximum sound at residential property lines is 55 dBA.
Loudoun County regulates bar and nightclub noise through two complementary ordinances. The Zoning Ordinance Section 5-1507 sets maximum A-weighted sound levels: sound from any commercial use (including bars and nightclubs) cannot exceed 55 dBA at residential property lines, 60 dBA at mixed-use residential, or 65 dBA at commercial property lines. These limits apply 24 hours a day. Chapter 654.02 of the Codified Ordinances provides additional regulation. The ordinance defines 'restaurant' to explicitly include bars, lounges, taverns, coffee shops, and cafes. Under the general prohibition (654.02(c)), no sound from these establishments may be audible and discernible inside another person's residential dwelling with doors and windows closed. Section 654.02(d)(5) specifically targets amplified sound: using or operating any instrument, machine, or device for producing sound that is plainly audible at a distance of 100 feet or more from the source is prohibited. Between 11:00 PM and 7:00 AM, amplified sound audible at 100 feet constitutes prima facie evidence of a violation. Loudoun County's growing entertainment districts in areas like One Loudoun and the Village at Leesburg have increased the relevance of these regulations as restaurants and bars operate near residential units in mixed-use developments.
First offense is a Class 3 misdemeanor (up to $500 fine). A second offense within six months is a Class 2 misdemeanor. A third offense within one year is a Class 1 misdemeanor (up to 12 months jail and $2,500 fine). The person operating or controlling the sound source is liable. The Board of Supervisors may also seek a circuit court injunction against continuing violations. Aggrieved citizens may apply to a Magistrate for a warrant.
