040(A) bars anyone engaged in construction, remodeling, digging, grading, demolition, painting, plastering, or any related building activity from operating a tool, equipment, or machine in a manner that produces loud noise disturbing, or that could disturb, a person of normal sensitivity who works or resides nearby, unless the work falls within the exceptions in subsection B. " Emergency work authorized in writing by the Community Development Director is allowed at any time, as is maintenance, repair, or improvement of a public work performed by public employees or under a public works contract, though the City itself only gets that exception if the City Manager or a department director finds the work immediately necessary, it cannot feasibly be done during normal hours, or the City Council has specifically approved off-hours work.

Subsection D defines a "designated high-density area" by reference to a High Density Map on file with the City Clerk, and subsection E lets a homeowners' association of at least thirty voting members with contiguous properties petition the City Council to exclude its boundaries from that high-density designation, which would otherwise narrow the Saturday construction window. Subsection C makes any landowner, contractor, subcontractor, or employer liable for permitting workers under their direction to violate these hours, not just the individual operating the equipment.
