NBMC Section 10.28.040 establishes permitted construction hours in Newport Beach. Weekday construction is allowed from 7:00 AM to 6:30 PM Monday through Friday. No construction, including demolition and grading, is allowed on Sundays or the following federal holidays: New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving, and Christmas. The Community Development Department at (949) 644-3200 may impose additional hour restrictions as conditions of building permits, particularly for major projects in noise-sensitive areas near the harbor, Balboa Peninsula, or Corona del Mar. Contractors must also comply with equipment noise limits. City inspectors and NBPD enforce construction hour violations.
Construction outside permitted hours is a code violation subject to administrative citations. Fines start at $100 for first offense and escalate with repeat violations. Stop-work orders may be issued. Chronic violations can result in permit revocation or conditions added to active permits.
