Bethlehem has no industrial-specific noise ordinance. Industrial properties are reached only through the Article 717.01 general nuisance rule and zoning-district controls. Section 717.01(b)(7) expressly exempts outdoor entertainment venues in Industrial Redevelopment and IR-Residential districts between noon and midnight.
Bethlehem's Codified Ordinances include no separate industrial-noise chapter with district decibel caps. Industrial operations are regulated by the Section 717.01(a) general nuisance ban, the Bethlehem Zoning Ordinance assigning industrial uses to specific districts including the Industrial Redevelopment District (IRD) and IR-Residential District (IR-RD), and site-specific land-development conditions. Section 717.01(b)(7), added by Ord. 2014-28 (passed 9/16/14), expressly exempts entertainment between 12:00 p.m. and 12:00 a.m. at outdoor venues in the IRD and IR-RD. That accommodates Wind Creek casino, SteelStacks, and ArtsQuest on the former Bethlehem Steel campus.
Outside the IRD/IR-RD carve-out, industrial noise is enforced under the Section 717.01(a) general nuisance rule with Section 717.99 penalties: $50-$100 first, $100-$300 second, $500 or 30 days for third and each subsequent. Site-specific conditions are enforced under the Zoning Ordinance.
