Under MCC 8-32, the maximum sound levels for industrial/manufacturing zones are 75 dB during daytime and 70 dB at night. When industrial noise reaches residential district boundaries, it must not exceed 55 dB daytime or 50 dB nighttime. The Environmental Noise Ordinance (MCC 11-4-2700) provides additional standards for continuous industrial operations, requiring measurement at property lines. Vibration from industrial sources must not create earthshaking vibrations beyond lot lines in any zoning district, except M3 (heavy manufacturing) zones. Fines range from $300 for a first offense to $1,000 for a third offense within one year.
First offense: $300 fine. Second offense within one year: $500. Third or subsequent offense within one year: $1,000. The superintendent of police may require a compliance plan. Repeat violators may face injunctive relief.
