Manufacturing in properly zoned Manatee County areas is exempt from the noise ordinance as long as it does not create a noise disturbance on land not zoned for such activity. Mining-operation noise is regulated separately under Chapter 2-20.
Section 2-21-33(3) exempts 'operation of manufacturing in areas zoned for such activities and which do not create a noise disturbance on any properties not designated for such activities.' So industrial noise contained within an industrial zone is allowed, but once it crosses into residential or other non-industrial land as a disturbance, it becomes enforceable. Where a residential parcel is adjacent to commercial use, the daytime limit rises to 72 dBA / 77 dBC (Β§ 2-21-34(2)(b)(2)). Noise from mining operations is cross-referenced to Β§ 2-20-33(m), and marina/port operations are separately exempt (Β§ 2-21-33(9)).
Industrial noise reaching non-industrial land is enforced under Β§ 2-21-35: $100 / $250 / $500 escalating civil fines within 365 days, or a second-degree misdemeanor notice to appear.
