Minnehaha County Code contains no provisions specific to leaf blowers, lawn mowers, weed trimmers, or other powered landscape equipment. The Public Nuisance Ordinance MC33-04 enumerates 14 categories of nuisance in Section 2 but does not include yard-equipment noise. The county Zoning Ordinance regulates structures, setbacks, and land use but not maintenance-equipment operation. As a rural, agriculturally oriented county with strong property-rights leanings, Minnehaha County has not pursued the type of gas-leaf-blower bans seen in coastal-state metros (California cities, Washington D.C., etc.). Gas, electric, and battery leaf blowers are all permissible at any hour. The only state-law constraints are (1) SDCL 22-18-35 disorderly conduct (Class 2 misdemeanor) for 'unreasonable noise' causing 'serious public inconvenience, annoyance, or alarm,' and (2) civil nuisance abatement under SDCL 21-10-1 for repeated, severe disturbance. Inside Sioux Falls, Brandon, Hartford, Dell Rapids, and the other municipalities, that city's general noise ordinance β and not county rules β applies.
No county penalty. Disorderly conduct under SDCL 22-18-35 is a Class 2 misdemeanor (up to 30 days jail and/or $500 fine) only if noise meets the 'unreasonable' standard.
