Hidalgo County has no leaf-blower ordinance. Gas and electric blowers may be used at any time in unincorporated areas because Texas counties cannot regulate equipment noise. Only the state unreasonable-noise statute could apply, and it rarely reaches ordinary landscaping equipment.
No Hidalgo County code restricts leaf blowers by fuel type, decibel rating or time of day, and no county has that authority under Texas law. Statewide, Texas HB 2127 (effective September 1, 2023) further discourages local restrictions on small-engine and lawn equipment. In unincorporated areas the only possible constraint is Texas Penal Code Sec. 42.01(a)(5), and Sec. 42.01(c)(2) presumes noise unreasonable above 85 decibels only after officer notice - a threshold that normal blower use, typically 65-75 dBA at 50 feet, seldom triggers. The Hidalgo County Sheriff's Office is the enforcing body. Cities within the county, such as McAllen and Edinburg, may address landscaping equipment through their own noise ordinances, but the unincorporated county does not.
There is no county leaf-blower penalty. Only Penal Code Sec. 42.01 could apply - a Class C misdemeanor, up to $500 - and generally only after an officer notifies the operator of a public nuisance.
