Outdoor music and amplified entertainment in unincorporated Merced County are governed by Chapter 10.60 of the County Code. Section 10.60.040 prohibits using or operating any loudspeaker, public address system, or similar device between 10:00 p.m. and 8:00 a.m. the following day where the sound creates a noise disturbance across a residential real property line. The same section also bars operating any stereo, radio, or similar amplifying device so as to disturb anyone other than the operator, which applies at any hour. These rules cover backyard parties, outdoor weddings, and venue speakers near rural homes. The chapter's numeric standards in Section 10.60.030, limiting residential noise to 65 dBA Ldn and 75 dBA Lmax at the property line, provide the measurable backstop. Importantly, Section 10.60.050 exempts activities conducted in public parks, public playgrounds, and public or private school grounds, including school athletic and entertainment events, as well as county-sponsored or county-approved events. Private events that are not county-approved must stay within the hours and limits above; large gatherings may also require a separate permit from the County. Enforcement runs through the general penalties of Chapter 1.28.
