In Utica parks, playgrounds and recreation areas, it is unlawful to play any radio, musical instrument or loudspeaker between 9:00 p.m. and 10:00 a.m. unless a permit is issued. Sound is also capped at plainly audible within 25 feet in public spaces.
Section 2-15-58(3) makes it unlawful to operate any radio, television, phonograph, musical instrument, loudspeaker or similar device between 9:00 p.m. and 10:00 a.m. in parks, playgrounds or recreation areas unless a permit has been issued under Section 2-15-67. At other times such devices still cannot be plainly audible at 25 feet in a public right-of-way or park. Noises from a City-sponsored concert or one with a City permit are exempt under Section 2-15-61(4), and church bells and chimes are exempt under 2-15-61(6).
