Because Texas counties cannot pass noise ordinances, El Paso County relies entirely on state law for vehicle noise. Texas Transportation Code Section 547.604 requires every motor vehicle to have a muffler in good working order and prohibits mufflers with cutouts or bypasses, and Section 547.605 bars amplifying exhaust. These are statewide traffic offenses the Sheriff and Texas DPS enforce on county roads, no local ordinance needed. Loud car stereos and 'boom cars' are handled under Texas Penal Code Section 42.01(a)(5) as unreasonable noise. Unlike cities, the county cannot set a decibel cap or an engine-braking (Jake brake) ordinance. Inside incorporated cities such as El Paso, additional municipal muffler and stereo ordinances may apply on top of the state traffic law.
Defective or bypassed mufflers are a traffic offense under Transportation Code 547.604-.605, citable by the Sheriff or DPS. A booming stereo can draw a Penal Code 42.01 citation (Class C misdemeanor, up to $500).
