Worcester County, MA Outdoor Lighting: Light Trespass (2026)

Light trespass in Worcester County is addressed through three overlapping channels. First, local zoning bylaws adopted under MGL c. 40A set specific property-line illumination limits: Worcester Zoning Ordinance §4.1 requires commercial outdoor lighting be designed to prevent glare onto adjacent residential properties with maximum 0.5 footcandle at residential property lines. Leominster, Fitchburg, Shrewsbury, and Westborough have similar commercial standards. Rural towns (Harvard, Bolton, Princeton) apply stricter limits often at 0.1 footcandle at any property line. Second, MA common-law private nuisance doctrine provides civil remedy — plaintiff must show substantial and unreasonable interference with property use (Asiala v. Fitchburg, 24 Mass. App. Ct. 13 (1987)). Third, MassDEP 310 CMR 7.10 (nuisance emissions regulation) has been used in limited cases for unreasonable light emissions though rarely enforced. Residential security lighting must be shielded so the light source is not directly visible from neighboring dwellings. Holiday lighting is generally exempt during seasonal windows (Nov 15 - Jan 15).
