Idaho Code 40-1910, part of the Beautification of Highways chapter, regulates outdoor advertising display lighting visible from any interstate or primary highway. Displays may not show red, blue, or blinking intermittent lights that could be mistaken for traffic warning signals, and may not include illumination of such brilliance, or so positioned, as to blind or dazzle the vision of travelers. No sign may interfere with the effectiveness of or obscure an official traffic sign, device, or signal, and beams or rays of light may not be directed at any portion of the traveled way. The rule applies statewide along regulated highways.
Violations may result in removal of the offending sign, civil penalties under Idaho Transportation Department enforcement, and loss of state outdoor advertising permits along controlled highways.
