In the unincorporated areas of Marion County, parking on public roads and rights-of-way is controlled primarily by Florida Statutes Section 316.1945, 'Stopping, standing, or parking prohibited in specified places,' which applies statewide as part of the State Uniform Traffic Control Law (Chapter 316). The statute prohibits stopping, standing, or parking a vehicle on the roadway side of any vehicle stopped or parked at the curb, on a sidewalk, within an intersection, on a crosswalk, on a bicycle path, on railroad tracks, on bridges, and at any place where official traffic control devices prohibit stopping. It separately bars standing or parking a vehicle (except momentarily to load or discharge a passenger) in front of a public or private driveway, within 15 feet of a fire hydrant, within 20 feet of a crosswalk at an intersection, and within 20 feet of a fire-station driveway entrance. Section 316.1945(3) authorizes a law enforcement officer or parking enforcement specialist who finds a vehicle parked in violation of the statute 'or a municipal or county ordinance' to issue or attach a ticket. The Marion County Land Development Code adds that no commercial vehicle over 10,000 pounds GVW may park in the right-of-way for more than three hours (LDC Sec. 4.3.21).
Under Florida Statutes Section 316.1945(4), a violation is a noncriminal traffic infraction punishable as a nonmoving violation as provided in Chapter 318. Officers may issue a ticket to the driver or, if the vehicle is unattended, attach a ticket to the vehicle.
