The Town of Huntington requires a building permit for any deck more than 8 inches in height. Decks over 30 inches above grade must have guardrails at least 36 inches tall. Standard residential setbacks (typically 4β10 feet from side and rear lot lines) apply, footings must be at least 42 inches deep, and the minimum residential permit fee is $100 plus square-footage charges.
Huntington's deck rules sit at the intersection of Chapter 87 (Building Construction Administration) of the Town Code and the New York State Residential Code (which the Town adopts and enforces). Article III (Building Permits) of Chapter 87 requires a building permit for any deck more than 8 inches above grade β that captures essentially every deck on a single-family lot. Decks must be 4 to 10 feet from side and rear lot lines depending on the underlying zoning district (R-3, R-5, R-7, R-10, R-15, R-20, R-40, R-80), and may not encroach into the required front yard. Per the New York State Residential Code R311 and R312, decks more than 30 inches above grade require guardrails at least 36 inches tall with balusters spaced so that a 4-inch sphere cannot pass through. Footings must extend below the local frost depth β 42 inches in the Town of Huntington β to prevent frost heave. Posts must be properly attached with code-listed connectors. The minimum residential permit fee is $100, plus an additional per-square-foot fee based on the submitted plans and survey. Applications go to the Town of Huntington Building Department at 100 Main Street, Room 115. Inspections include footings (before pour), framing, and final.
Constructing a deck without a Town building permit, or failing inspections, can result in a stop-work order from the Building Department and after-the-fact permitting (typically at higher fees). Continued non-compliance may be cited to Suffolk County District Court. Unpermitted decks must also be disclosed on the property record and can derail a future Certificate of Occupancy or home sale.
