Huntington, NY Noise Ordinances: Amplified Music & Outdoor Sound (2026)

Article III of Huntington's noise chapter, §§ 141-9 through 141-20, requires a Town Clerk-issued sound permit before anyone operates a loudspeaker, PA system or other amplified sound device on or near a street, park or public place for anything other than advertising. The property owner, the person in charge of the premises, their agent, and any disc jockey, band or performer at the event are all liable if the device runs without a permit on file. Under § 141-11, the property owner or lessee (or an authorized agent, with the owner's written consent) must file a written application with the Town Clerk at least three business days before the event, pay a nonrefundable $25 application fee, and disclose the event's location, dates, hours of use and the type of sound equipment involved.

The Town Clerk, acting on the Director of Public Safety's recommendation, may approve the request in whole or in part and attach conditions under § 141-12, or deny it in writing. , or where traffic, overcrowding or street work would make the amplified sound hazardous. A handful of uses never need a permit: religious services on their own premises, town-sponsored events, government agencies performing their duties, organized school and league sporting events, and a homeowner's own personal, non-commercial use at a residence, so long as none of these rise to an unreasonable, disturbing volume.

m. Every permit issued must be posted at the premises for the entire event under § 141-16, cannot be transferred to another address or user under §§ 141-17 and 141-19, and the Town Clerk may revoke it under § 141-20 for false statements or noncompliance, forfeiting the fee.
