A. A motor vehicle shall be deemed to be an abandoned vehicle if left unattended as follows: (1) With no license plates affixed thereto, for more than six hours on any highway or other public place; (2) With license plates affixed on any highway or other public place in such a way that poses a risk to public safety or otherwise obstructs, impedes or interrupts the flow of traffic, except a portion of a highway or public place on which parking is legally permitted. (3) For more than forty-eight (48) hours, after the parking of such vehicle shall have become illegal, if left on a portion of a highway or public place on which parking is legally permitted. (4) For more than ninety-six (96) hours on a portion of a highway or public place on which parking is otherwise legally permitted. B. No person shall cause any vehicle to be an abandoned vehicle. There shall be a rebuttable presumption that the owner of an abandoned vehicle caused such vehicle to be abandoned. A violation of this provision shall be deemed a violation, punishable by a fine of not less than one hundred dollars ($100.) nor more than one thousand dollars ($1,000.).
