New York Vehicle and Traffic Law authorizes the Town of Islip to remove and store vehicles abandoned on highways during emergencies or found where stopping, standing or parking is prohibited, and Islip's Traffic Code Chapter TC6 governs the removal and storage of such vehicles with charges payable by the owner.
The Town's power over abandoned and obstructing vehicles comes from NY VAT Sec. 1660(a)(8), which authorizes a town board to provide for the removal and storage of vehicles parked or abandoned on highways during snowstorms, floods, fires or other public emergencies, or found unattended where they constitute an obstruction to traffic or any place where stopping, standing or parking is prohibited, and to charge the owner or operator reasonable removal and storage costs. Islip implements this through Chapter TC6 of its Traffic Code (Removal and Storage of Vehicles). Genuinely abandoned vehicles are also addressed by NY VAT Article 14-A (Sec. 1224), which governs the disposition of abandoned vehicles. Islip Town Code separately addresses junked and unregistered vehicles on private property under its property-maintenance provisions.
Vehicles removed under Chapter TC6 may be impounded, and the registered owner is responsible for reasonable removal and storage charges before release. Owners of abandoned vehicles may also face citation; unclaimed vehicles are disposed of under the procedures of NY VAT Sec. 1224.
