Islip enforces a winter overnight on-street parking ban: from December 15 through March 15, no vehicle may park on a residential or business-district street between 3:00 a.m. and 6:00 a.m. (Snow Emergency Ordinance, Sec. TC3-11), and parking in any Town parking lot is prohibited between 3:00 a.m. and 6:00 a.m. year-round except by permit (Sec. TC4-2B).
Islip's overnight parking controls come from two parts of the Traffic Code, both enacted under the town authority of NY VAT Sec. 1660(a)(18) and the snow-emergency power of Sec. 1660(a)(27). Section TC3-11 (Snow emergency regulations) makes the winter ban effective 'from the 15th of December to the 15th of March and between the hours of 3:00 a.m. and 6:00 a.m.': no motor vehicle may be parked on a residential street (TC3-11A) or on any street in a business district (TC3-11B). When a snow emergency is separately declared, Sec. TC3-12 adds snow-tire/chain requirements and bans parking on residential streets and on the even side of business-district streets. Separately, Sec. TC4-2B prohibits parking in any Town parking lot between 3:00 a.m. and 6:00 a.m. of any day except by permit or as designated by signs. Outside the winter window, Islip does not impose a blanket year-round overnight ban on ordinary passenger cars on public streets, but commercial vehicles and personal trailers are banned 9:00 p.m. to 6:00 a.m. (Sec. TC5-2 and Sec. TC3-3.1B).
A first violation of the Sec. TC3-11 winter ban is punishable by a fine of not more than $75 or up to 15 days' imprisonment; a second conviction within 18 months is up to $150, and a third or subsequent conviction within 18 months is up to $250 (or imprisonment up to 15 days, or both). Vehicles obstructing snow removal may be towed under Chapter TC6.
