Commercial vehicles, tractor-trailers, buses and advertising vehicles are banned from parking on any Islip town road between 9:00 p.m. and 6:00 a.m. (Sec. TC5-2), and it is unlawful to park a commercial vehicle on a public roadway at all except while actively loading/unloading or working on a property (Sec. TC5-3); trucks over 5,000 pounds are excluded from streets listed in Schedule M (Sec. TC5-1).
Chapter TC5 of the Islip Traffic Code regulates commercial vehicles. Section TC5-1A excludes all trucks, commercial vehicles, tractors and tractor-trailer combinations over 5,000 pounds maximum gross weight from the streets in Schedule M; pickup trucks, school buses and recreational vehicles are exempt (Sec. TC5-1A(1)). Section TC5-2 (overnight ban) prohibits all commercially registered vehicles, tractor-trailers, buses (including minibuses) and advertising vehicles from parking on any town road between 9:00 p.m. and 6:00 a.m. Section TC5-3 (added 6-11-2002) makes it unlawful to park a commercial vehicle on any public roadway except while actively engaged in loading/unloading passengers or merchandise or while actively working on a property in the Town; emergency, municipal and public-utility vehicles engaged in street or utility work are excepted. A 'commercial vehicle' includes every trailer and semi-trailer, vehicles designed for more than 10 passengers or used to transport persons for compensation, and trucks over two tons GVW. The Town's exclusion authority derives from NY VAT Sec. 1660(a)(17), which lets a town exclude commercial vehicles and tractor-trailer combinations from specified highways.
Violating the Sec. TC5-2 overnight commercial ban is punishable by a fine of not more than $250 or imprisonment for not more than 15 days, or both. Section TC5-3 and the Schedule M weight exclusions are enforced through the Parking Violations Bureau and code enforcement, with towing available under Chapter TC6.
