San Jose requires a building permit for decks over 30 inches above grade. Uncovered patios at grade level generally do not require permits. Covered patios and pergolas with roof structures require permits. Section 311 notification may apply to new decks.
San Jose requires a building permit for decks more than 30 inches above adjacent grade, per the California Residential Code. Decks 30 inches or less above grade that are not attached to the dwelling may be exempt. Uncovered concrete or paver patios at grade level generally do not require building permits. Covered patios (with a solid or open-lattice roof) require a building permit. Under San Jose Planning Code Section 311, new decks, deck enlargements, and stairs over 3 feet above grade require neighborhood notification β neighbors within 300 feet are mailed a notice and have 15 days to file objections or an appeal with the Board of Appeals. Deck plans must include footing details, ledger board attachment, guardrail specifications (42 inches high for decks 30+ inches above grade per California code), and stairway details. Permit fees are based on project valuation, typically 6-9% of construction cost.
Building without a permit: stop-work order, administrative citation, and retroactive permitting required.
