In Manhattan, temporary portable freestanding sheds under 120 sq ft and no taller than 7'6" on one- or two-family dwelling lots are exempt from building permits, provided they meet setback and use requirements. Larger sheds require DOB permits.
Under 1 RCNY 101-14, temporary portable freestanding sheds on the same zoning lot as a one- or two-family dwelling are exempt from DOB permit requirements if they meet all of the following conditions: the shed does not exceed 120 square feet in area; it is not more than 7 feet 6 inches in height; it does not obstruct any required window; it is not located within 3 feet of any lot line; it is used for storage of normal household goods or tools; and there is not more than one such shed on any tax lot. Sheds exceeding any of these thresholds require a building permit. Given Manhattan's density and predominance of multi-family buildings, standalone sheds are extremely rare. Properties in Manhattan's many historic districts should consult the Landmarks Preservation Commission before installing any accessory structure, even if permit-exempt. For sidewalk sheds (protective coverings during construction), a separate DOB Scaffold & Shed Permit is required.
Installing a shed without required permits is a DOB violation with penalties starting at $2,500. Sheds in violation of setback requirements may be subject to removal orders. In historic districts, unpermitted structures can result in LPC fines up to $5,000 per day until the violation is corrected.
