Garage sales allowed without a permit, limited to 3 per household per year, each up to 3 consecutive days. Items must stay on private property.
Montgomery County permits garage sales, yard sales, and estate sales on residential properties without requiring a special permit or license. Each household is limited to three sales per calendar year, with each sale lasting a maximum of three consecutive days. Sales may operate during reasonable daytime hours, typically 8 AM to dusk. All merchandise must be displayed on private property and may not extend into the sidewalk, street, or public right-of-way. Temporary signage is permitted on the property where the sale occurs but may not be placed on utility poles, traffic signs, or public property. Sales tax does not apply to occasional personal property sales by individuals in Maryland. No business license is required as long as the sales remain occasional and non-commercial in nature. HOA communities may have additional restrictions on garage sale frequency and signage.
Sales exceeding frequency limits may be treated as a commercial activity requiring a business license. Signs in the right-of-way are subject to removal. Report concerns to MC311.
