Collier County requires household garbage containers and bags to be secured from bear intrusion until the day they may go curbside. Commercial establishments must store litter in containers that eliminate wind-blown debris; overflow around containers counts as an unlawful litter accumulation and must be cleaned up immediately.
Residential customers must store solid-waste containers and bags secured from bear intrusion until they may be set out (Sec. 118-104.C.2); a county-approved bear-resistant curbside container is optional. Under Sec. 54-183, commercial establishments must store litter in enough containers to keep premises clean, neat and sanitary, and any spillage or overflow around a container is an unlawful accumulation of litter that must be cleaned up as it occurs. In deed-restricted communities the Land Development Code requires enclosed storage areas (garage/carport) rather than leaving carts in view. Cans should not be stored where they create a nuisance.
Unlawful litter accumulation is a nuisance under Sec. 54-179. Solid-waste violations are prosecuted under FS 125.69 (Sec. 118-108); Chapter 118, Art. III violations carry up to a $500 fine or 60 days jail (Sec. 118-58). Report at 239-252-2440.
