The county Property Maintenance Code requires every dwelling to have approved, leakproof, covered garbage containers and covered rubbish containers, and premises must stay free of any accumulation of rubbish or garbage. This applies in unincorporated areas; cities set their own container rules.
Chapter 29 (Property Maintenance Code) governs how trash must be stored on unincorporated county property. Section 29-3-52 forbids any accumulation of rubbish or garbage. Section 29-3-53 requires occupants to place rubbish in approved covered containers, with the property owner supplying them. Section 29-3-54 requires garbage be placed in an approved leakproof, covered outside container (or an approved grinder/incinerator). Discarded refrigerators must have doors removed. Inside incorporated cities, the municipal code sets container and set-out rules instead.
Failure to store trash properly is a Property Maintenance Code violation - a petty offense under 730 ILCS 5/5-4.5-75, with each continuing day a separate offense (SCC 29-1-36).
