Baltimore County Code Section 13-4-201 requires all solid waste to be kept in approved receptacles and all garbage to be stored in rodent-resistant, watertight containers with tight-fitting lids. Premises must be kept free from accumulations of improperly stored solid waste.
County Code Section 13-4-201 (Method of solid waste storage) sets the storage rules countywide. Subsection (b) requires a person to keep the premises free from accumulations of improperly stored solid waste; subsection (c) requires all solid-waste storage at public and private properties to be in approved receptacles suitable for storage; and subsection (d) requires all garbage to be stored in approved rodent-resistant, watertight containers with tight-fitting lids. Section 13-4-202 makes the occupant responsible for the sanitary condition of the premises. For set-out, the Bureau of Solid Waste Management requires a watertight, rodent-resistant, sturdy outdoor container with handles and a tight-fitting cover, limited to 45 gallons and 45 pounds filled (up to 96 gallons where mechanical tippers are used).
Improperly stored solid waste is a code violation enforced by Code Enforcement and the Bureau of Solid Waste Management. Non-conforming set-outs may result in non-collection; nuisance accumulations can be abated under Article 13, Title 7 with penalties up to $1,000.
