Merced County's solid waste ordinance requires every premises to keep enough containers to hold all refuse without leakage or odor, and garbage containers must stay closed against flies, rodents and other animals. Day-to-day setout for the carts is governed by each franchised hauler's rules.
The Merced County Code's refuse provisions require that no person fail to provide a sufficient number of containers to receive and hold, without leakage or escape of odors, all refuse produced or accumulated on any premises, and that all refuse be stored in those containers until properly disposed of. Containers for garbage must be kept continuously closed except when garbage is being placed in or removed from them, and must at all times be closed against the access of flies, rodents and other animals; containers must be kept in good, useful and sanitary condition to the standards set by the health officer. Curbside cart service in the unincorporated area is delivered by the hauler franchised for each community. For example, Gilton Solid Waste (serving Dos Palos Y, El Nido, Santa Nella and areas outside Dos Palos/Los Banos) provides weekly collection with a black 'municipal solid waste' cart for household garbage, glass, plastic, cans and tin, and a green organics cart. Waste Management and Mid Valley Disposal serve other communities. Leftover material should not extend beyond the container rim; carts that cannot close or that are overfilled may not be serviced.
Failure to provide adequate, closed, sanitary containers is a violation of the County refuse ordinance and is enforceable as a public nuisance. Haulers may decline to service overfilled carts or carts whose lids cannot close, and may apply contamination tags for mis-sorted material.
