Unincorporated El Paso County has no numeric grass-height ordinance. State law (Tex. HSC Sec. 343.011) makes weeds a public nuisance only when they grow within 300 feet of another residence or commercial establishment, and the county abates on that basis.
Texas counties cannot set a city-style 'grass over X inches' rule, so El Paso County relies on the state public-nuisance statute for the unincorporated area. Tex. Health & Safety Code Sec. 343.011(c)(4) defines a nuisance as 'allowing weeds to grow on premises in a neighborhood if the weeds are located within 300 feet of another residence or commercial establishment.' The trigger is proximity, not a fixed height, so a rural tract with no neighbors within 300 feet is generally not covered. Under Sec. 343.022 the owner must clear the weeds before the 31st day (or 10th business day for a repeat notice). Reports of a '9-inch, 2.5-acre' rule refer to El Paso County, COLORADO, not Texas.
An owner who fails to clear qualifying weeds after notice faces county abatement after the deadline (31 days, or 10 business days for repeats), with the cost liened. Violating Chapter 343 is a Class C misdemeanor.
