Town of Herndon Code regulates weeds and grass under its nuisance abatement authority granted by Virginia Code Section 15.2-900 and 15.2-901. Overgrown vegetation is declared a public nuisance because it harbors rodents and insects, conceals debris, creates fire hazard, and contributes to neighborhood blight. The Town notifies the property owner of a violation via written notice, typically giving 7 to 10 days for the owner to mow or otherwise abate the condition. If the owner fails to comply, Town crews or contractors will cut the grass and all costs, including administrative fees, are assessed against the property as a lien that can be collected with real estate taxes. Repeat offenders within the same growing season may receive shortened notice periods or no notice under streamlined procedures authorized by VA Code 15.2-901. Natural landscaping, wildflower meadows, and conservation areas may be exempt if designed and maintained intentionally and approved by the zoning administrator; simply allowing a yard to grow wild does not qualify. Noxious weeds listed by the Virginia Department of Agriculture must be controlled regardless of height.
