California Health and Safety Code section 11362.3 prohibits smoking or consuming cannabis in public places. Riverside County applies the rule across unincorporated parks, sidewalks, and any location where tobacco smoking is also banned.
Proposition 64 legalized adult-use cannabis but Health and Safety Code section 11362.3 prohibits consumption in public places, in vehicles, within 1,000 feet of schools or day care while children are present, and anywhere smoking tobacco is restricted. Riverside County extends the rule to county-controlled parks and beaches under Ordinance 539. Licensed cannabis-consumption lounges are permitted only with state license type 9 and local approval; unincorporated Riverside County does not currently authorize such lounges. Cultivation and dispensary zoning fall under Ordinance 348.4801.
Public cannabis consumption is an infraction with up to $100 fine. Possession in protected zones, such as near schools, can elevate to misdemeanor under Health and Safety Code section 11362.3.
