Adults 21 and older may possess and use cannabis in New York under the Marijuana Regulation and Taxation Act, but consumption is banned anywhere tobacco smoking is banned, including indoor workplaces, parks, schools, and many outdoor public spaces in Westchester.
The MRTA (NY Cannabis Law, 2021) treats cannabis smoking like tobacco for location purposes. Use is barred in cars, schools, federal property, and within Westchester County parks under Chapter 484. Vaping cannabis is treated the same. Westchester County opted in to retail dispensaries, which are licensed by the NY Office of Cannabis Management. Public consumption tickets are civil violations rather than criminal charges, but using on school grounds or selling to minors remains criminal under NY Penal Law.
Public smoking violations carry civil fines around $25 for a first offense. Driving impaired or possessing more than three ounces in public can lead to misdemeanor or felony charges.
