Loudoun County has not adopted a formal rental inspection district program under Virginia Code Section 36-105.1:1. Virginia law authorizes localities to establish rental inspection districts but does not require them. The county enforces property maintenance standards through the Virginia Uniform Statewide Building Code (Property Maintenance Code) on a complaint-driven basis rather than through proactive rental inspections. Unlike some Virginia localities (such as Hampton, Norfolk, and Richmond), Loudoun County has not adopted a rental inspection ordinance under Virginia Code Section 36-105.1:1. That statute authorizes local governing bodies to adopt ordinances creating rental inspection districts for the purpose of inspecting residential rental dwelling units for compliance with the Building Code. Before establishing such a district, a locality must hold a public hearing and make findings that there is a need to protect public health and safety, that dwelling units are blighted or deteriorating, and that inspection is necessary to maintain safe and sanitary conditions. Loudoun County instead relies on complaint-based enforcement of the Virginia Uniform Statewide Building Code, specifically the Property Maintenance Code (Part III). The county's Zoning Enforcement Team responds to complaints under Chapter 3 (Exterior Property Areas) and Chapter 4 (Light, Ventilation and Occupancy Limitations) of the Virginia Maintenance Code. All residential and commercial structures must be maintained in good repair per code requirements. The county also enforces its Residential Occupancy Ordinance which limits single-family homes to a family plus up to 2 roomers/boarders, or no more than 4 unrelated persons. Property maintenance violations are addressed through the complaint and inspection process. The county issues a Notice of Violation with a compliance deadline. Failure to comply may result in civil penalties or referral to the Commonwealth's Attorney. The Building Official may condemn units that pose immediate health or safety hazards under the Virginia Maintenance Code.
