Miami-Dade enforced state and federal COVID-19 eviction moratoria from March 2020 through August 2021. The CDC moratorium was struck down by the Supreme Court, and Florida ended its emergency protections. No local moratorium currently exists in the county.
Florida Governor DeSantis issued executive orders in 2020 suspending residential evictions for nonpayment due to COVID-19, and the federal CDC moratorium ran in parallel. The Supreme Court vacated the CDC rule on August 26, 2021 in Alabama Ass'n of Realtors v. HHS, ending federal protection. Florida's emergency orders had already expired in October 2020. Miami-Dade processed an Emergency Rental Assistance Program (ERAP) using federal funds, distributing over $200 million to landlords on behalf of tenants. ERAP closed to new applications in 2023. No local moratorium exists today, and Florida HB 1417 preempts new local moratoria.
Landlords now follow standard FL §83.56 three-day notice and §83.59 eviction procedures; ERAP-related fraud claims may still be prosecuted by the State Attorney.
