Rent control is illegal in every Essex County community. Massachusetts voters banned it statewide in 1994 through ballot Question 9, now codified as MGL Chapter 40P. No Essex city or town can cap residential rents or tie increases to a government formula.
Chapter 40P, the Massachusetts Rent Control Prohibition Act, forbids any city or town from enacting, maintaining, or enforcing rent control of any kind. It reaches beyond rent caps to any regulatory scheme controlling evictions, condominium conversion, or occupancy tied to below-market rents. Lynn, Lawrence, Haverhill, and Salem set rents through the open market. A municipality could adopt limited regulation only by formally accepting the chapter and compensating owners from tax funds, and no Essex community has. Publicly owned, subsidized, and federally assisted housing, plus mobile homes, fall outside the ban.
A rent-control ordinance would be void and unenforceable under state law. Tenants cannot claim rent-control protection anywhere in Essex County; landlords set and raise rents freely, subject only to notice requirements and the lease terms.
