Monroe County is NOT covered by NY ETPA rent stabilization. Rochester considered opt-in after 2019 HSTPA but has not adopted. Good Cause Eviction Law applies statewide for certain buildings (2024).
Monroe County is not covered by New York's Emergency Tenant Protection Act (ETPA) rent stabilization, which applies primarily to NYC and certain Westchester, Nassau, and Rockland municipalities. After the 2019 Housing Stability and Tenant Protection Act (HSTPA), upstate municipalities gained the option to opt into ETPA upon declaring a housing emergency (under 5% vacancy rate). Rochester has studied opting in but has not adopted. The 2024 NY Good Cause Eviction Law (Real Property Law Article 6-A) applies statewide to qualifying rentals in buildings 10+ units built before 2009, limiting rent increases to the lower of 10% or CPI+5% and requiring "good cause" for non-renewal. Individual towns may opt in or out for their jurisdiction.
