Rent control rules in Mendocino County, CA — also known as rent stabilization or rent cap ordinances — limit annual rent increases and protect tenants from displacement.
There is no rent control ordinance in unincorporated Mendocino County. State law — AB 1482 (Cal. Civil Code §1947.12) — caps annual rent increases on most covered residential units at 5% plus the regional CPI, with an absolute maximum of 10% per 12 months.
Mendocino County has not adopted a local rent stabilization or rent control ordinance. State law applies. California Civil Code §1947.12, enacted by AB 1482, caps annual rent increases for covered residential rental units at the lesser of (a) 5% plus the percentage change in the Consumer Price Index for the regional area, or (b) 10% of the lowest gross rental rate charged in the prior 12 months. A landlord may not raise rent more than twice in any 12-month period, and the total of those increases is also subject to the cap. Exemptions mirror those of §1946.2 and include units built within the previous 15 years, deed-restricted affordable housing, certain single-family homes owned by non-corporate owners with proper notice, and owner-occupied duplexes. Costa-Hawkins Rental Housing Act preempts strict price controls on new construction and on vacant units after a tenant moves out, allowing vacancy decontrol.
Rent increases that exceed the AB 1482 cap are void as to the excess. A tenant who has paid excessive rent can recover the overpayment, and the landlord may face damages and attorney's fees in an action under §1947.12.
