Under N.D. Cent. Code § 47-16-07, a North Dakota landlord may change the rent or other terms of a month-to-month lease by giving the tenant written notice at least 30 days before the end of the month. North Dakota sets no cap on how much rent may be raised.
Section 47-16-07 provides that 'in all leases of land or tenements... from month to month, the landlord may change the terms of the lease to take effect at the expiration of the month upon giving notice in writing at least thirty days before the expiration of the month.' Once served, the notice becomes part of the lease if the tenant keeps possession after the month ends. There is no statutory ceiling on the increase amount and no state rent control. A fixed-term lease cannot be raised mid-term unless the lease allows it. Notice may be served 'in any reasonable manner which actually informs the tenant.' If a landlord changes terms this way, § 47-16-15(3) lets the tenant end the lease with 25 days' notice.
No specific statutory penalty. A rent change served with fewer than 30 days' written notice is not effective for the coming month; the prior rent remains owed until a valid 30-day notice has run.
