NY General Obligations Law section 7-103 and section 7-108, as amended by HSTPA in 2019, limit residential security deposits to one month rent regardless of pet status, smoking status, or rental history. Landlords must conduct a pre-move-out inspection on tenant request and provide an itemized statement of any deductions for damages beyond ordinary wear and tear. Deposits in buildings of six or more units must accrue interest payable to the tenant. Failure to return the deposit within fourteen days waives the landlord's right to retain any portion. Nassau County's CHRO investigates discriminatory deposit practices.
