The protection applies even if surrounding land uses change, such as residential development encroaching on existing farms. Operations must comply with applicable laws, regulations, and best management practices to retain protection. Negligent or improper operation, or operations that materially expand beyond their original character, may lose the statutory shield. Counties may further regulate land use through zoning consistent with state law.
