North Dakota Right to Farm law under NDCC 42-04 protects established agricultural operations from nuisance lawsuits when surrounding land uses change over time.
NDCC 42-04 establishes that an agricultural operation in existence for more than one year is not a public or private nuisance based on changed conditions in the surrounding area. The protection covers crop production, livestock, dairy, poultry, and other commercial agriculture, including normal noises, odors, dust, and traffic associated with farming. Plaintiffs cannot sue established operations simply because they moved closer to the farm, a doctrine often called coming to the nuisance. Protections do not extend to operations that violate state or federal environmental laws, fail to follow generally accepted agricultural practices, or substantially change in nature. Local zoning ordinances cannot retroactively declare protected farms a nuisance.
Lawsuits filed against protected farms may be dismissed with prevailing operations entitled to attorney fees and costs under NDCC 42-04-04. Farms that lose protection through environmental violations or substantial changes face traditional nuisance liability. Local ordinances that conflict with the Right to Farm shield are unenforceable against protected operations.
